According to the Federal Trade Commission (FTC) to label a product “Made in USA” all or virtually all of the product must be made in the United States. The "all or virtually all" standard requires three things:
- Final assembly or processing must occur in the United States
- All significant processing must take place in the United States
- All or virtually all ingredients or components must be made and sourced in the United States
Companies that mislabel their products could face a large fine and legal action. For this reason, companies should verify compliance carefully before making unqualified "Made in USA" claims. Intertek offers a range of traceability solutions applicable to products made in the USA and within global supply chains that companies may consider when wishing to market products as “Made in the USA”: Traceability Assurance.
